The missed post from JaWoodle

Why do we care if some dude making youtube videos has to stand in the naughty corner after having disclosed business secrets and not played ball? I couldn't care less about him. I don't get how people seem to have allegiances to content creators as if they matter in any way. Stop giving these people power.
 
Jost. TFP has done some shady things. Said some nasty things to their fan base. Shady thing number one. They took promised content that was already in the game. Removed it then sold it back to the fans. That is shady. I am talking about armors that were planned as part of future releases, shown to us. Then monetized instead. Removed clothes from the game so they could sell monetized outfits. Etc. Shady. But, I love the game. Most of the things over the thousands of hours and versions of the games I have played. TFP has been right about to change or delay. But I am not blinded. I see reality and describe it as I see it.

They didn't remove armors, in fact, you can craft all types of supported armors without needing any DLC.
They added vanity content in the form of outfits as an optional way to support the devs, if you felt so inclined (and I did).

Clothes ARE in the base game. They even added a clothing tab in the character sheet, maybe you missed it?

I think they're talking about the Desert and Hoarder sets, which if I remember right, were shown as and talked about as actual armor sets, and ended up being cosmetic DLC.
 
Just a reminder: TFP commented on this issue, saying that those bandits were from a very early build, and they didn't make a big deal out of it - only to later go after a content creator. Defending TFP from that perspective is just making excuses for a company that can't even respect its own NDA. Their actions make sense only if data mining was actually covered by their agreement, until it's clear for us any discussion is pointless.
 
They did convert some of the armors over to DLC. I think the Marauder set and maybe a few others were originally shown to be coming in 1.0 when they revamped the character system.

I wouldn't call it shady as well. But since they already had shown the armors as part of the upcoming update some form of "sorry guys, we needed some contents for an upcoming DLC" or explanation "after fully designing the armor bonusses those armors didn't fit in so we decided to convert them to skin DLCs" would have been good form.

Though it is also possible that they were already in talks of selling at that time and any smallest hint that they needed money (whether true or not) could have cost them more than the revenue from the sets. In that case a very understandable move.
 
I beg to differ. You'd need to cite some serious case law to convince me otherwise. US and Australian; related to:
1) Does the developer of SW automatically inherit any rights over video recordings of use of said SW?
I assume not. TFP does too - they're demanding for those rights in their EULA, they wouldn't if they didn't need to.
2) IS that EULA-derived transfer of rights enforceable in Australia and USA?
I haven't ran into any case law that would establish that for this case.
3) Even if the EULA-transfer of rights stands, is it still Fair Use to slap your own face on it and make content; the content with commentary is completely different from the SW recording itself.
It might well be, it is quite transformative in the legal sense (the standard for that isn't as high as people think)

I think those are the easiest to understand "soft spots" in this particular case; and I honestly don't know if these have been ruled on by relevant courts... if you got court links, I'd be happy to see :)

I would add to your list: unintended disclosure of privileged information. There are laws around this and legal recourses that help protect both parties in such situations. The most typical application, as far as I understand, is around "what if I send this very important email to the wrong person?" And the true legal answer to that question is most definitely NOT "they get to do whatever they want with that information, your mistake so you lose."

There's stuff there like the party who accidentally disclosed the information has to demonstrate that they took every step they could to inform the other party that the privileged information was not intended for them. JaWoodle has already lost on that metric because he has publicly shared that TFP made that notification.

And I expect all of that ends up boiling down to what is in the wording of the partner program agreement.

Sadly, I expect you are right that there's no way this makes its way to court. I think we're at the end of the story between those two and all that's left is blowback on TFP for their actions here.

Yeh, that might be a thing that's highly depending on state, though. I don't know, so I didn't even mention anything of the sort. There's probably layers to that, with damage type; protecting some actual person's life / reputation etc, versus .. this is a "vague potential financial harm to a private business". Not very high on a "things we must protect" -list; but I wouldn't be surprised if some states were very trigger happy around something like that as well.

I don't really support TFP's decision to take down the vid (I assume that's what happened), it's pointless and looks petty/vengeful. But I would fully expect them to kick Woodle from the partner program; he's not acting as a well-intentioned partner either.

Eh, it's borderline to me. Had they mentioned something along the lines that not all armors would be included in the base game and making DLC out of some was an option it would have been fine. But showing all of them off as 1.0 content and then holding some of them back for DLC is basically shady to me. It isn't a good look no matter how you wanna frame it. Almost like they are so unorganized in development that they don't know what the plan a few months from now is. Again, not a good look, period.

Just poking fun, buddyh. You are talking about the team that releases armless characters, infinite stamina, invulnerability, perfect invisibilty etc etc as par for course for stable branch ... knowing what they're doing seems to be about 3 months AFTER the fact, not a few months ahead :P

Heh, they at least fixed the arms relatively quickly. Timing on that was pretty bad with the new DLC drop though.

Some things they do aren't that surprising, and usually isn't really that harmful to anyone. But I'd think if I was going into a stream as a dev to show off content I'd wanna make sure what the plan for it is.

I think I don't particularly care at all. I think I'm just too old to really "get" streamers or to relate to a gaming community's love for particular streamers. It seems like a really poor decision on TFP's part, though. The cat is out of the bag and nothing will put the cat back in, so there are only two possible things this could achieve: 1. make JaWoodle fans angry at TFP, 2. give fuel to people who already have an axe to grind with TFP.

So why they did this is entirely beyond me. Maybe they need to hire a grown up?

This. I've actually had a theory that the current iteration of Pack Mule may have originally been part of the Hoarder set, but they weren't able to come up with bonuses for each piece and turned it into a cosmetic while creating the updated Pack Mule perk. Saying something would've been nice, but communication wasn't exactly their strong suit for a long time.

No one else aside from us really talked about it like GNS prbuild or anyone as far as I saw

There's stuff from the files that are findable but I don't share and other very small channels that do we well.

Tbh he probably didnt know when he got that version that the others didn't have that one Woodley had but him not just taking it down after is kinda the finial nail
