If your controller is wireless you might try just taking out the batteries or the battery pack if you use one, and then using a USB cable plugged into the Xbox and set the controller on the side.  Normally if it is hard wired the controller doesn't go to sleep.

Unfortunately there isn't anything that they can do legally. TFP hands are tied in the situation, they cannot provide any updates/bug fixes/etc. for consoles until the publishing rights issue is straightened out.
